Important: Wildara is a marketplace platform only — not a hunting or fishing organiser, travel agency, or licensed guide service. All experiences are independently operated by third-party providers. You are solely responsible for legal compliance, safety, and insurance.
1. About Wildara — Marketplace Only+
Wildara AS ("Wildara", "we", "us") operates solely as a digital marketplace and intermediary platform. We connect independent experience providers ("Providers") with buyers ("Guests").
Wildara is NOT:
- An organiser of hunting or fishing experiences
- A travel agency or package travel operator
- A licensed hunting or fishing guide service
- An insurer or guarantor of any experience
- Responsible for the actions, omissions, or negligence of any Provider
Wildara IS:
- A technology platform facilitating introductions between Providers and Guests
- A communication channel between parties
- A listing and discovery service
By using Wildara, you acknowledge and accept this distinction entirely and unconditionally.
2. Legal Compliance — Your Sole Responsibility+
You are solely and entirely responsible for ensuring full compliance with all applicable laws before, during and after any experience booked through Wildara. This includes but is not limited to:
Hunting:
- Holding a valid hunting licence for your country of residence
- Paying the Norwegian State hunting fee (jegeravgift) if required
- Possessing valid species-specific permits and quotas where applicable
- Complying with the Norwegian Wildlife Act (Viltloven), Wildlife Resources Act (Viltressursloven), and Nature Diversity Act
- Holding valid weapons permits and documentation for firearm import/export in all transit countries
- Complying with CITES regulations for trophy import/export where applicable
- Understanding and adhering to all bag limits, season dates, and area restrictions
Fishing:
- Paying the Norwegian State fishing fee (fiskeravgift) for salmon, sea trout and Arctic char in rivers
- Holding any additional local fishing permits required by the specific water body
- Complying with the Norwegian Salmon and Inland Fish Act and all associated regulations
- Adhering to catch-and-release rules where mandated
- Complying with restrictions on fishing methods, equipment, and bait
General:
- Compliance with Norwegian immigration and customs regulations
- Compliance with your home country's regulations regarding hunting trophies and fish import
- Compliance with EU wildlife trade regulations if applicable
Wildara accepts zero liability for any legal violations, fines, prosecutions, confiscations, or consequences arising from your failure to comply with any applicable law or regulation.
3. Provider Responsibility+
All Providers on Wildara are independent operators. Wildara does not employ, supervise, control, or direct Providers in the performance of their services.
Providers are solely responsible for:
- The accuracy and completeness of their listings
- Informing Guests of ALL requirements, risks, physical demands, and restrictions
- Holding valid operating licences and permits
- Ensuring their land, water, or vessel rights are valid and unencumbered
- Health and safety of Guests during experiences
- Their own liability insurance coverage
- Tax compliance on all income received
- Compliance with all applicable laws and hunting/fishing regulations
Wildara does not verify, audit, or guarantee the accuracy of Provider listings, credentials, permits, or qualifications. Wildara's review of listings is limited to basic content moderation only and does not constitute endorsement, verification, or approval of any Provider.
4. No Warranty — Platform Provided "As Is"+
Wildara provides its platform on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to:
- Accuracy, completeness, or timeliness of listings
- Fitness for a particular purpose
- Uninterrupted or error-free service
- That any experience will meet your expectations
- That Providers will honour bookings
- That wildlife will be present or catchable
- Favourable weather or hunting/fishing conditions
- Any specific outcome from any experience
Wildara expressly disclaims all warranties to the maximum extent permitted by applicable law.
5. Limitation of Liability+
To the maximum extent permitted by applicable law, Wildara, its directors, employees, agents, partners, and shareholders shall not be liable for:
- Personal injury, death, or disability arising from any experience
- Loss or damage to property, equipment, firearms, or personal belongings
- Financial loss, lost profits, or economic damage
- Cancellation, no-show, or failure to perform by any Provider
- Acts of God, extreme weather, wildlife behaviour, or other circumstances beyond anyone's control
- Illegal acts by Providers or other Guests
- Technical failures, data loss, or service outages
- Any indirect, consequential, special, punitive, or exemplary damages
In no event shall Wildara's total liability exceed the platform fee actually paid to Wildara in connection with the specific booking giving rise to the claim.
Some jurisdictions do not allow exclusion of certain warranties or limitation of liability — in such cases, liability is limited to the minimum extent permitted by applicable law.
6. Indemnification+
You agree to indemnify, defend, and hold harmless Wildara AS and its directors, employees, agents, and partners from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including legal fees) arising from:
- Your use of the Wildara platform
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your hunting or fishing activities
- Any injury, death, or damage caused by you or your party during any experience
- Any illegal act committed by you or your party
- Any inaccurate information you provide to Wildara or any Provider
7. Booking Terms+
7.1 Nature of Booking — A booking request through Wildara constitutes an expression of intent only. No binding contract exists between Guest and Provider until the Provider explicitly confirms the booking in writing.
7.2 Platform Fee — Wildara charges a platform fee for each confirmed booking. This fee is non-refundable under any circumstances once a booking is confirmed, including in cases of cancellation by either party, no-show, weather, injury, or any other reason.
7.3 Payment — Payment terms are agreed directly between Guest and Provider. Wildara is not a party to the payment transaction unless explicitly stated.
7.4 Cancellation — Cancellation policies are set by each Provider and displayed on the listing. Wildara is not responsible for enforcing, mediating, or guaranteeing any refund from any Provider.
7.5 Disputes — Disputes between Guests and Providers are the sole responsibility of the parties involved. Wildara may, at its sole discretion, attempt to mediate disputes but is under no obligation to do so and accepts no liability for any outcome.
8. Risk Acknowledgment — Hunting and Fishing+
You explicitly acknowledge that:
- Hunting and fishing involve inherent and significant risks including serious injury, permanent disability, and death
- Wildlife is unpredictable and dangerous
- Norwegian terrain, weather, and wilderness conditions can be extreme and life-threatening
- You are voluntarily participating in these activities at your own risk
- You are physically and medically fit to participate in the chosen experience
- You have relevant experience and skill for the activities booked
- You have read and understood all Provider requirements, restrictions, and safety guidelines
- You accept full personal responsibility for all risks associated with your participation
- Wildara has not assessed and is not responsible for your fitness, skill level, or suitability for any experience
9. Insurance+
You are strongly advised to obtain comprehensive travel and activity insurance before participating in any experience booked through Wildara, including coverage for:
- Medical evacuation and emergency repatriation
- Hunting or fishing accidents
- Trip cancellation and interruption
- Personal liability
- Equipment and firearms
Wildara does not provide insurance of any kind. Wildara accepts no liability for losses that would be covered by appropriate insurance.
10. Firearms and Weapons+
If your experience involves the use of firearms or other weapons, you are solely responsible for:
- Holding all required licences and permits in Norway and your country of residence
- Complying with Norwegian Firearms Act (Våpenloven) and associated regulations
- Proper storage, transport, and handling of all weapons at all times
- Any customs, import, and export requirements
- Any incidents, accidents, or injuries involving your weapon
Wildara accepts zero liability for any matter related to firearms or weapons.
11. Trophy Export and CITES+
If your experience results in a hunting trophy, you are solely responsible for:
- Compliance with CITES (Convention on International Trade in Endangered Species) where applicable
- Obtaining all necessary export permits from Norwegian authorities
- Obtaining all necessary import permits for your home country
- Compliance with EU and national wildlife trade regulations
- All costs associated with trophy preparation, transport, and import
Wildara accepts no responsibility for seized, confiscated, or prohibited trophies.
12. Data and Privacy+
Your use of Wildara is subject to our Privacy Policy, incorporated herein by reference. By accepting these Terms, you also accept our Privacy Policy in its entirety.
13. Intellectual Property+
All content on Wildara, including but not limited to text, images, logos, and software, is the property of Wildara AS or its licensors. You may not copy, reproduce, distribute, or create derivative works without explicit written permission.
Provider content remains the property of the Provider, who grants Wildara a non-exclusive licence to display it on the platform.
14. Governing Law and Jurisdiction+
These Terms are governed by Norwegian law. Any dispute arising from these Terms or your use of Wildara shall be subject to the exclusive jurisdiction of Oslo District Court (Oslo tingrett), Norway, unless mandatory consumer protection laws in your country of residence require otherwise.
15. Changes to Terms+
Wildara reserves the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the new Terms. Material changes will be communicated by email to registered users.
16. Severability+
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17. Entire Agreement+
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Wildara regarding your use of the platform and supersede all prior agreements.
